1. DATA PRIVACY STATEMENT

dr-ouwerkerk ag - just-medical! (hereinafter «just-medical!») will only request your personal data if this is unavoidable in order for you to use our services. We will give you the choice of how the personal data you enter will be used, and who can see it. just-medical! guarantees to maintain discretion regarding all the personal data you entrust to us. We assure you that these data are collected with the greatest care, treated in strict confidence, and used only for their intended purpose. In so doing, just-medical! will adhere to all definitive statutory provisions and to the following principles. By entering your personal data on the websites of just-medical!, you express you willingness for your personal data to be processed in accordance with these data protection guidelines. We use the term "Designated Countries" to refer to countries in the European Union (EU), European Economic Area (EEA), and Switzerland.

2. COLLECTION AND STORAGE OF DATA

2.1 Data entry

All data entrusted to just-medical! are stored in the just-medical! databank, treated with strict confidence, and not passed on to third parties.

2.2 Advertisers

If the online platform of just-medical! is offered for the publication of ads or journalistic content, advertisers (providers, employers, recruiters, event organisers) collect all necessary data when opening a new user account for invoicing and administering their client relationship with just-medical! All data generated by the User during the business relationship remain in the just-medical! databank during the period of publication (and during a limited period thereafter) in order to simplify the reactivation of the business relationship at a later point in time. If these customer data remain unused for a longer period, just-medical! reserves the right to delete them.

By beginning their membership, the User agrees that data regarding transactions made in the User’s name (including details of offered products, residence and postcode of the member, offers they have made, etc.) will be shown on the online platform of just-medical! for a limited period, even after expiry of the offer duration. To protect the parties involved, however, after transactions are concluded they can only be retrieved by using their offer number.

You then give your consent to the storage and use of your data for this purpose even after your membership has ended. In particular, please note that evaluations you give or receive will remain visible, and that statutory data retention duties exist.

2.3 Storage of access data

When the websites of just-medical! are called up, general access data is also stored in a logfile for statistical purposes. Specifically, this affects:

  • IP addresses
  • Date and time of access
  • Name of the file retrieved
  • Access status (OK, partial content, document not found, etc.)
  • Pages from which the access originated
  • Top-Level Domain (TDL) (*.ch, *.fr, *.com etc.)
  • Web browser used
  • Operating system used
  • Duration of access
  • Download activities

just-medical! processes these data in anonymised form (e. g., in order to identify days on which there was a particularly high number of accesses). No personal evaluation of the logfiles takes place.

just-medical! uses web analysis services on its online platform which show how the individual websites are used. This information is used to improve and optimise our services.

2.4 Google Analytics

Google Analytics is a service of Google Inc. («Google»). In order to provide this service, Google uses cookies, which are stored on your data carrier. Basically, the data collected are transmitted to a Google server in the USA. The IP addresses are anonymised using IP anonymisation to prevent allocation to specific persons. Furthermore, Google participates in the «Safe Harbor» treaty of the USA’s Department of Commerce with Switzerland and the European Union, and commits to adhere to the data protection principles it contains.

just-medical! websites use the following Google Analytics functions: display advertising (AdSense), remarketing, evaluating impressions in the Google Display Network, DoubleClick Campaign Manager and Google Analytics reports.

2.5 Social Media Plugins

just-medical! incorporates functions («plugins») from various third-party providers of social media platforms (such as Facebook, Twitter, just-medical!, XING, and Google+). These plugins allow visitors to share content in social networks. If a plugin appears on the website while surfing (e. g., Facebook’s «like» button), a connection to the servers of this website is automatically established. In so doing, data can be transmitted to third-party providers via just-medical!. If the visitor is also logged into the network of this third-party provider, the visit to just-medical! can be assigned to the visitor’s network (e. g., Facebook) account. just-medical! has no influence on the type of this data transfer. The purpose and scope of the data collection, the further processing and use of the data by the User’s social media provider, as well as the User’s rights in this regard and their possibilities for adjusting settings to protect the private sphere, can be read in the provider’s data protection notice.

3. DATA SECURITY

just-medical! employs technical and organisational security measures reflecting state-of-the-art technology to protect the administered data against accidental or intentional manipulation, loss, destruction or access by unauthorised third parties. These security measures are continually improved in accordance with technological developments. However, just-medical! assumes no liability for the loss of data, or its disclosure and use by unauthorised parties.

4. PAYMENT USING ONLINE PAYMENT SYSTEMS

just-medical! offers its clients various products and services which are subject to a charge. According to the offer, just-medical! offers the payment options of invoices, credit cards, PayPal or Postcard. Payments with credit cards or Postcard are made using online payment systems such as Postfinance, Yellowpay or SIX. In this case, personal and payment data (credit cards or Postcard numbers) are processed directly by these providers. just-medical! neither knows nor stores any customer payment data. just-medical! is notified by these providers electronically about the payment status, so that just-medical! can undertake delivery of the products or activate the services purchased by the customer. The storage and handling of personal and payment data through these providers is subject to the appropriate data protection regulations, which can be found on the appropriate platforms. just-medical! asks its clients to consult these regulations before using the payment options.

If the User enters post- or bank account information (or both) into their member account, they allow just-medical! to use these data for any refunds of fees made to the User, and to share these data with the respective contracting party, if the User registers the data.

5. THIRD-PARTY OFFERS

just-medical! also presents third-party offers on its websites, or inserts links to offers or websites from third parties. just-medical! assumes no responsibility for the collection and handling of personal data by these third parties. The data protection regulations of the respective third-party provider shall apply.

6. ALTERING OR DELETING DATA

Each client can delete their own ads, unless the ads were realised through just-medical!. The deletion of client data can also be commissioned with an e-mail to just-medical!. Information from published ads can only be edited by the client it affects.

We keep most of your personal data for as long as your account is open.

We retain your personal data while your account is in existence or as needed to provide you Services. This includes data you or others provided to us and data generated or inferred from your use of our Services. Even if you only use our Services when looking for a new job every few years, we will retain your information and keep your profile open until you decide to close your account. In some cases we choose to retain certain information (e. g., visits to sites carrying our «share with just-medical!» or «apply with just-medical!» plugins without clicking on the plugin) in a depersonalized or aggregated form.

6.2 Rights to Access and Control Your Personal Data

You can access or delete your personal data. You have many choices about how your data is collected, used and shared.

We provide many choices about the collection, use and sharing of your data, from deleting or correcting data you include in your profile and controlling the visibility of your posts to advertising opt-outs and communication controls. We offer you settings to control and manage the personal data we have about you.

For personal data that we have about you:

  • Delete Data: You can ask us to erase or delete all or some of your personal data (e. g., if it is no longer necessary to provide Services to you).

4.3 Account Closure

We keep some of your data even after you close your account.

If you choose to close your just-medical! account, your personal data will generally stop being visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfill your request to «unsubscribe» from further messages from us. We will retain de-personalized information after your account has been closed.

Information you have shared with others will remain visible after you closed your account or deleted the information from your own profile or mailbox, and we do not control data that other Members copied out of our Services. Groups content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e. g., search engine results) until they refresh their cache.

7. OTHER IMPORTANT INFORMATION

7.1 Security

We monitor for and try to prevent security breaches. Please use the security features available through our Services.

We implement security safeguards designed to protect your data, such as https. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

7.2 Cross-Border Data Transfers

We store and use your data outside your country.

We process data both inside and outside of the United States and rely on legally-provided mechanisms to lawfully transfer data across borders. Countries where we process data may have laws which are different, and potentially not as protective, as the laws of your own country.

Every client has the right to demand information about whether just-medical! is storing their personal data, and which data is being stored. Inquiries in this regard should be directed to just-medical! in an e-mail. Other questions regarding this data protection statement can also be directed to just-medical!. just-medical! will try to answer questions as soon as possible.

9. AMENDMENTS TO THIS DATA PROTECTION STATEMENT

just-medical! reserves the right to amend these GBC at any time. Amendments will be published on just-medical! websites.
